General information
The following information provides a simple overview of what happens to your personal data when you visit this website. Personal data is any data by which you can be personally identified. Detailed information on the subject of data protection can be found in the privacy policy set out below this text.
Data collection on this website
Who is responsible for the data collection on this website?
Data processing on this website is carried out by the website operator. You can find the operator’s contact details in the section “Information on the controller” in this privacy policy.
How do we collect your data?
Your data is collected, on the one hand, by you providing it to us. This may, for example, be data that you enter in the booking form.
Other data is collected automatically or with your consent by our IT systems when you visit the website. This is primarily technical data (e.g. internet browser, operating system or time the page was accessed). This data is collected automatically as soon as you enter this website.
What do we use your data for?
Part of the data is collected in order to ensure that the website is provided without errors. Other data may be used to analyse your user behaviour.
What rights do you have regarding your data?
You have the right to receive information about the origin, recipients and purpose of your stored personal data free of charge at any time. You also have the right to request that this data be corrected or deleted. If you have given your consent to data processing, you can withdraw this consent at any time with effect for the future. You also have the right, under certain circumstances, to request that the processing of your personal data be restricted. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.
You can contact us at any time regarding this and any other questions on the subject of data protection.
2. Hosting
IONOS
We host our website with IONOS SE. The provider is IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany (hereinafter IONOS). IONOS is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website as reliably as possible. Where corresponding consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TTDSG, to the extent that the consent covers the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be withdrawn at any time.
3. General information and mandatory information
Data protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.
When you use this website, various items of personal data are collected. Personal data is data by which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.
We would like to point out that data transmission over the internet (e.g. when communicating by e-mail) may have security gaps. Complete protection of data against access by third parties is not possible.
Information on the controller
The controller responsible for data processing on this website is:
BD Parkraum GmbH
Modering 1
22457 Hamburg
Represented by the Managing Director Burak Orhan
Phone: +49 40 573 07 641
E-mail: info@yourplacehamburg.de
The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses or similar).
Storage period
Unless a more specific storage period is stated within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a justified request for deletion or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible grounds for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case the data will be deleted once those grounds no longer apply.
General information on the legal bases for data processing on this website
If you have consented to the data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, where special categories of data pursuant to Art. 9(1) GDPR are processed. In the case of express consent to the transfer of personal data to third countries, data processing is also carried out on the basis of Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access to information on your device (e.g. via device fingerprinting), the data processing is additionally carried out on the basis of § 25(1) TTDSG. Consent can be withdrawn at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data where this is necessary for compliance with a legal obligation, on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR. Information on the legal bases relevant in each individual case is provided in the following paragraphs of this privacy policy.
Withdrawal of your consent to data processing
Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out until the withdrawal remains unaffected by the withdrawal.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
IF THE DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS THE PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING IN SO FAR AS IT IS CONNECTED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged breach. This right to lodge a complaint is without prejudice to any other administrative or judicial remedies.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only take place in so far as it is technically feasible.
SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.
When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Information, deletion and correction
Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to have this data corrected or deleted. You can contact us at any time regarding this and any other questions on the subject of personal data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do so. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of your personal data stored by us, we generally need time to check this. For the duration of the check, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data happened or is happening unlawfully, you can request the restriction of the data processing instead of deletion.
- If we no longer need your personal data but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
- If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been established whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.
Objection to advertising e-mails
The use of contact data published within the framework of the legal notice obligation to send advertising and information material that has not been expressly requested is hereby objected to. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example by spam e-mails.
4. Data collection on this website
Cookies
Our internet pages use what are known as “cookies”. Cookies are small text files and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are deleted automatically at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or until they are deleted automatically by your web browser.
In some cases, cookies from third-party companies may also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for handling payment services).
Cookies have various functions. Many cookies are technically necessary, since certain website functions would not work without them (e.g. the shopping basket function or the display of videos). Other cookies serve to evaluate user behaviour or to display advertising.
Cookies that are required to carry out the electronic communication process, to provide certain functions requested by you (e.g. for the shopping basket function) or to optimise the website (e.g. cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is stated. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. Where consent to the storage of cookies and comparable recognition technologies has been requested, the processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TTDSG); consent can be withdrawn at any time.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be restricted.
Where cookies from third-party companies or for analysis purposes are used, we will inform you separately about this within the framework of this privacy policy and, where applicable, request your consent.
Server log files
The provider of the pages automatically collects and stores information in what are known as server log files, which your browser automatically transmits to us. These are:
- browser type and browser version
- operating system used
- referrer URL
- host name of the accessing computer
- time of the server request
- IP address
This data is not merged with other data sources.
This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose the server log files must be recorded.
Enquiry by e-mail, telephone or fax
If you contact us by e-mail, telephone or fax, your enquiry including all personal data resulting from it (name, enquiry) will be stored and processed by us for the purpose of dealing with your request. We do not pass on this data without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is connected with the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be withdrawn at any time.
The data you send to us via contact enquiries remains with us until you ask us to delete it, withdraw your consent to storage or the purpose for storing the data no longer applies (e.g. after your request has been dealt with). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
ParkStar booking system
Your parking space is booked via the ParkStar booking system (parkpool.parkstar.de). A booking widget is embedded on the home page and the complete booking form on the “Book parking” page. Both are loaded in a frame (iframe) directly from parkpool.parkstar.de, as is a script that adjusts the height of the frame. In the course of this, your IP address is transmitted to the provider of the booking system, even if you do not complete a booking.
If you complete a booking, we process the details you enter – in particular name, address, e-mail address, telephone number, travel and flight details, vehicle details as well as the number of people travelling with you and any additional services requested – in order to prepare and perform the parking contract. The legal basis is Art. 6(1)(b) GDPR. If you create a customer account in the process, we process the details provided for as long as the account exists; statutory retention periods remain unaffected.
The booking system is embedded on the basis of Art. 6(1)(b) GDPR (initiation and performance of a contract) and of our legitimate interest in a functioning online booking facility (Art. 6(1)(f) GDPR).
5. Plugins and tools
Fonts from Bunny Fonts
For the uniform display of fonts, this site uses web fonts from Bunny Fonts. When you call up a page, your browser loads the required fonts from fonts.bunny.net. In the course of this, the provider obtains knowledge of your IP address. According to the provider, no cookies are set and no access data is stored permanently in the process.
The web fonts are used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in the uniform presentation of our website. Where corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TTDSG; consent can be withdrawn at any time.
The provider is BunnyWay d.o.o., Slovenia. Further information can be found in the provider’s privacy policy: https://bunny.net/privacy/.
Google tag and Google Ads
This website embeds the Google tag (gtag.js) for Google Ads with the identifier AW-11243265197. The tag is loaded from www.googletagmanager.com; in the course of this, your IP address is transmitted to Google. We use it to measure whether a visit came about via one of our advertisements. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
We use what is known as consent mode: for visitors from the EU and the EEA, consent to advertising, analysis and personalisation purposes is set to “denied” by default. Cookies and comparable recognition technologies for advertising are therefore only used once you have given your consent. The legal basis is then Art. 6(1)(a) GDPR and § 25(1) TTDSG; consent can be withdrawn at any time with effect for the future.
Google also processes data outside the EU. You can find more detailed information on how Google handles your data in Google’s privacy policy: https://policies.google.com/privacy?hl=en.
Photos from Unsplash
One photo on the home page is loaded directly from the servers of Unsplash (images.unsplash.com). In the course of this, your IP address is transmitted to the provider. It is embedded on the basis of Art. 6(1)(f) GDPR; we have a legitimate interest in an appealing presentation of our website.
On this website you will find links to our WhatsApp contact (wa.me). No chat window is embedded in the page; data is only transmitted once you click on one of these links. You are then forwarded to WhatsApp, and your telephone number and your message are processed by WhatsApp. The provider is WhatsApp Ireland Limited, Merrion Road, Dublin 4, Ireland.
If you write to us via WhatsApp, we process your message in order to deal with your request (Art. 6(1)(b) GDPR, otherwise Art. 6(1)(f) GDPR). WhatsApp’s data protection provisions also apply: https://www.whatsapp.com/legal/privacy-policy-eea.
Google Maps
For directions, we link to Google Maps with “Plan your route”. No map is embedded in the page; data is only transmitted once you click on the link and open the Google page. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. You can find more detailed information in Google’s privacy policy: https://policies.google.com/privacy?hl=en.
6. eCommerce and payment providers
Processing of data (customer and contract data)
We collect, process and use personal data only in so far as it is necessary for the establishment, content arrangement or amendment of the legal relationship (inventory data). This is done on the basis of Art. 6(1)(b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures. We collect, process and use personal data about the use of this website (usage data) only in so far as this is necessary to enable the user to use the service or to bill the user for it.
The customer data collected is deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.
Transfer of data upon conclusion of a contract for services and digital content
We transfer personal data to third parties only where this is necessary in the course of handling the contract, for example to the credit institution commissioned to process the payment.
Any further transfer of the data does not take place, or only takes place if you have expressly consented to the transfer. Your data is not passed on to third parties without your express consent, for example for advertising purposes.
The basis for the data processing is Art. 6(1)(b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures.
Payment
Payment is made on site, in cash or by German debit card (EC card). We do not collect any payment data such as account or credit card numbers via this website, and we do not integrate any payment service providers.
